What You Need to Know About Schedule 26 Statutory Supervisor Training
By March 31st, 2026, all Statutory Supervisors in Western Australia must complete specific WHS units of competency to meet the mandatory eligibility criteria.
Our Statutory Supervisor Course is specifically designed for mining professionals who want to fulfil these requirements and become industry-leading Statutory Supervisors.
Essential Information for Aspiring Statutory Supervisors in the Mining Sector:
Understanding Your Obligations
Part 10.7A of the Work Health and Safety (Mines) Regulations 2022 sets out the requirements for specific positions within the mining industry. These statutory positions, appointed by the mine operator, carry specific responsibilities essential to the safe and effective operation of a mine.
These roles are categorised based on their functions, obligations, and the necessary levels of knowledge, experience, and qualifications required. Some of these positions also require statutory certificates.
What Are Statutory Positions? Under the WHS law, mine operators must ensure that appropriately qualified individuals are appointed to the statutory positions listed in Schedule 26 of the WHS Mines Regulations.
Our Statutory Supervisor course meets the WHS risk management training requirements for several key positions, including:
- Underground Supervisor (Non-Coal)
- Underground Supervisor (Coal)
- Restricted Quarry Manager
- Statutory Supervisor
- Mine Air Quality Officer
- Noise Officer
- Electrical Supervisor
For a complete list of approved WHS risk management units for statutory positions, please refer to the relevant guidelines.
Does Schedule 26 Replace Section 44? Yes, the requirements previously outlined in Section 44 under the Mines Safety and Inspection Act 1994 have now been superseded by the Work Health and Safety (Mines) Regulations 2022.
What’s the Deadline? According to the transitional provisions under the WHS Mines Regulations, a competent person can be appointed to a statutory supervisor position until March 20th, 2026, at the latest. Make sure you’re prepared and compliant before this deadline.
